By accessing and using SearchApp ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. YouTube Terms of Service

By using SearchApp's YouTube features (including video search, trending videos, and video details), you agree to be bound by the YouTube Terms of Service.

Our Service uses YouTube API Services. Your use of YouTube data through our Service is subject to YouTube's terms and policies. We recommend reviewing these terms before using our YouTube features.

3. Service Description

SearchApp is a unified search platform that provides access to various search services including:

• General web search (Google, Bing, etc.)
• AI assistants (ChatGPT, Claude, etc.)
• News search (via Mediastack API)
• Movies and TV shows (via TMDB and JustWatch)
• YouTube videos (via YouTube API Services)
• Music search (via Spotify API)
• Social media search
• Image search
• Personal saved items and folders

4. User Accounts

To access certain features of our Service, you must create an account using Microsoft Azure AD authentication. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Violate any third-party terms of service (including YouTube ToS)
• Abuse API rate limits or attempt to circumvent quota restrictions
• Use automated systems to scrape or download content excessively
• Impersonate any person or entity
• Upload or transmit malicious code

6. Third-Party Services

Our Service integrates with various third-party APIs and services. Your use of these services through SearchApp is subject to their respective terms:

• YouTube Terms of Service
• Spotify Terms and Conditions
• TMDB Terms of Use

7. User Content

You retain ownership of any content you save through our Service (saved items, folders, notes). By using our Service, you grant us a license to store and display this content to you.

You are responsible for ensuring you have the right to save and organize content through our Service.

8. Subscription Plans

SearchApp offers both Free and Pro subscription tiers:

• Free Plan: Limited to 50 saved items
• Pro Plan: Unlimited saved items and additional features

Subscription fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice to existing subscribers.

9. Intellectual Property

The Service and its original content (excluding user content and third-party data) are owned by byteNine and are protected by copyright, trademark, and other intellectual property laws.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Results from third-party APIs will be accurate or reliable
• Any defects will be corrected
• The Service is free from viruses or harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTENINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Violation of third-party terms (including YouTube ToS)
• Abusive or excessive use of the Service
• At your request

Upon termination, your right to use the Service will immediately cease. You may request a data export before account deletion.

13. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Service notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
